Occupational Health and Safety

Service Overview

Our occupational health and safety team works with employers to proactively manage workplace risk, maintain regulatory compliance, and respond effectively when workplace incidents occur. We provide practical and strategic advice tailored to each client’s operations, helping employers understand and meet their obligations under occupational health and safety legislation while minimizing disruption to their business and workforce.

We assist employers with the development, implementation, and review of workplace health and safety policies, programs, and procedures designed to prevent incidents and reduce liability exposure. Our services include advising on due diligence obligations, hazard identification, workplace investigations, reporting requirements, contractor and subcontractor responsibilities, workplace violence and harassment issues, and the roles and responsibilities of supervisors, managers, and workers. We also support employers with compliance audits, Joint Health and Safety Committee matters, and overall workplace safety strategy.

In addition to proactive compliance work, we provide immediate guidance and representation when workplace accidents, critical injuries, fatalities, or other serious incidents occur. We help employers respond to Ministry of Labour inspections and investigations, manage communications with regulators, address compliance and stop-work orders, and conduct internal investigations in a manner that protects both legal and operational interests. Our team also advises directors, officers, supervisors, and management personnel regarding potential personal liability and due diligence obligations.

Miller Canfield regularly represents employers, supervisors, and corporate officers facing charges under occupational health and safety legislation. Our defence work includes responding to regulatory prosecutions, developing due diligence strategies, negotiating resolutions with prosecutors, representing clients in court and administrative proceedings, and managing appeals where necessary. We also assist clients in navigating related employment, insurance, and civil liability issues that may arise from workplace incidents and enforcement proceedings.

Our approach is practical, responsive, and industry-focused. We work with employers across a broad range of sectors, including manufacturing, construction, transportation, logistics, healthcare, retail, and professional services, helping organizations create safer workplaces while effectively managing legal, operational, and reputational risk.
